Terms of Service

Version: V1.0 | Effective Date: April 13, 2026

This Terms of Service is a legally binding agreement between you and Beijing FET Intelligent Electrical Technology Co., Ltd. regarding your use of all FSTSMART services, including website, mobile apps, smart hardware, and related software services.

1. General

  • Purpose: define rights, obligations, and legal responsibilities of both parties.
  • Scope: official website, mobile applications, hardware/software products, cloud services, and support services.
  • Acceptance: by accessing or using services, you agree to all terms.
  • Entity: agreement is signed between user and Beijing FET Intelligent Electrical Technology Co., Ltd.
  • Updates: terms may be revised according to legal or business changes.

2. Definitions

  • FSTSMART: Beijing FET Intelligent Electrical Technology Co., Ltd. and affiliates.
  • Services: all products, software, websites, applications, support, and related offerings.
  • User: natural person, legal person, or organization using services.
  • Account, Content, Intellectual Property, and Third-Party Services are defined accordingly.

3. Account Management

  • Registration information must be accurate, complete, and updated.
  • Users are responsible for account credentials and all activities under their account.
  • Accounts must not be lent, transferred, or unauthorizedly used by others.
  • Users may request account deletion; data will be handled per applicable law and privacy policy.

4. Service Content and Usage Rules

  • Service includes product presentation, quotations, transaction support, technical document downloads, cloud platform, consulting, and after-sales support.
  • Access channels include website and official support emails.
  • Prohibited behavior includes unlawful use, IP infringement, harmful content, attacks, unauthorized access, reverse engineering, unauthorized scraping, and competitive abuse.
  • FSTSMART reserves rights to remove violating content and suspend/terminate service access.
  • Services may change or pause due to maintenance, failures, upgrades, or force majeure.

5. Intellectual Property

  • FSTSMART owns or legally uses IP related to software, hardware designs, trademarks, documents, source code, schematics, algorithms, and other service contents.
  • No copying, modification, reverse engineering, distribution, sale, rental, or unauthorized use without written permission.
  • User content ownership remains with user; user grants necessary license for service delivery purposes.
  • IP complaints can be submitted to support@fstsmart.com with valid evidence.

6. Third-Party Services and Links

  • Third-party links are provided for convenience; use is at user risk.
  • Third-party SDKs/services may be integrated for certain functions; partners are selected prudently.

7. Disclaimer and Limitation of Liability

  • Services are provided on an "as is" and "as available" basis to the maximum extent permitted by law.
  • No guarantee of uninterrupted or error-free operation.
  • No liability for force majeure events including disasters, war, government action, cyberattacks, telecom failure, and power outages.
  • Maximum liability is limited to fees paid in the 12 months prior to claim (if any) or statutory minimum.

8. Indemnity

You agree to indemnify and hold harmless FSTSMART and its affiliates, officers, employees, and agents against third-party claims arising from your breach, infringement, misuse, or user-provided content.

9. Export Control Compliance

  • Products, software, and technology may be subject to PRC and international export control laws.
  • Users must not directly or indirectly export/re-export/transfer to sanctioned countries, entities, or individuals.
  • Required export permissions must be obtained by users where applicable.

10. Termination

  • FSTSMART may suspend or terminate services for material breach, fraud, illegal behavior, regulatory requirement, or service shutdown decisions.
  • Post-termination clauses that naturally survive remain valid (IP, liability limits, dispute resolution, etc.).

11. Governing Law and Dispute Resolution

  • Governing law: laws of the People's Republic of China (excluding conflict-of-law rules).
  • Disputes should first be resolved by friendly consultation; unresolved disputes are submitted to the competent court at FSTSMART's domicile.
  • International users retain mandatory consumer protections granted by applicable local law.

12. Miscellaneous

  • Entire agreement, severability, no waiver, and notice provisions apply.
  • Notice channels include website announcements, email, SMS, and in-app messages.
  • Chinese version shall prevail in legal interpretation. Other languages are for convenience only.
